What You'll Be Tested On

This is the most rule-dense section. Questions test specific statutory language, not general principles.

Unfair Practices — Expect questions about conduct that constitutes a violation under Georgia license law: misrepresentation, commingling, blockbusting, steering, and failure to disclose. Know the difference between conduct that suspends a license versus what triggers revocation.

Substantive Regulations — Covers Commission rules governing broker and salesperson conduct. Know Rule 520-1-.06 and its requirements around brokerage relationships, including timing of written disclosures. Questions here often hinge on a single word ("timely," "written," "party") that changes the correct answer.

Qualifications and Fees — Age requirements, education prerequisites, and the license application process. Know what disqualifies an applicant and what the Commission can waive.

Fair Housing Laws — Georgia's fair housing provisions layer on top of federal law. Know the protected classes, the exemptions, and what advertising language is prohibited. Georgia-specific enforcement is tested here, not just federal HUD procedure.

Real Estate Education, Research and Recovery Fund — Know the maximum recovery amounts, who can file a claim, the order of payment, and what happens to a licensee's license after a Recovery Fund payment is made on their behalf.

Sales Contracts — Know Georgia's standard contract provisions: earnest money handling, contingency periods, and what constitutes a binding contract under Georgia law. Questions often describe a scenario and ask whether a valid contract exists.

Listings and Agency — Brokerage relationship types recognized in Georgia (client vs. customer, designated agency, dual agency). Timing and content of required disclosures are heavily tested — see Rule 520-1-.06.

Property Management — Handling of security deposits, maintenance obligations, and the Georgia landlord-tenant framework. Know what a property manager can and cannot do without a real estate license.

Community Association Management — Georgia's Community Association Manager licensing requirements are a distinct subtopic. Know who must be licensed, what activities require a license, and what exemptions exist.


Finance and Closing — 15 items

Expect both rule-based and calculation-based questions.

Finance — Trust account requirements are heavily tested. Know the timeline rules for depositing funds (O.C.G.A. § 43-40-20(a)), what qualifies as commingling, and the rules around interest-bearing accounts. Mortgage instrument types and lien priority may also appear.

Closing Procedures — Georgia closing customs, the role of the closing attorney, proration calculations, and disbursement requirements. Be ready to calculate prorated taxes or rent given a specific closing date. Know what must appear on a settlement statement and who is responsible for what.


Worked Sample Questions

Question 1 — Real Estate Practice In Georgia

As a Georgia real estate salesperson, you are representing a buyer who wants to make an offer on a property listed by your firm. When must the written disclosure of your firm's brokerage relationship be made to both buyer and seller?

Correct answer: C. Rule 520-1-.06(4)(b) sets a clear deadline: written disclosure must occur in a timely manner, but no later than when any party first makes an offer. "At closing" (B) is far too late. "At the listing signing" (A) addresses only one party. The 48-hour rule (D) does not exist in the statute — a classic distractor.


Question 2 — State Laws and Rules

How many members compose the Georgia Real Estate Commission, and how are they appointed?

The Governor appoints; the Senate confirms. Option D swaps in the Secretary of State, which is wrong. Option C invents an election process that doesn't exist.


Question 3 — Finance and Closing

If a broker does not maintain a trust account but later receives trust funds, they must open the required trust account within ______ of receiving such funds.

- B. One business day
- C. Three business days
- D. One week

Correct answer: B. O.C.G.A. § 43-40-20(a) requires the account to be opened within one business day. "Three business days" is a common wrong answer because candidates confuse it with deposit deadlines in other contexts. The distinction between a calendar day and a business day matters here.


How to Read Your Score

The passing threshold is 75% — that's 39 correct out of 52 on the real exam.

On your first practice attempt, treat the score as a diagnostic, not a verdict. A 60% on your first pass tells you something useful: which of the three topic areas cost you the most points. A topic-by-topic breakdown matters more than the total at this stage.

If you score near 75% on practice, that is not a comfortable margin. The real exam's question pool is different, and pressure affects performance. Candidates who pass cleanly typically score well above the cutoff in practice — aim for consistent scores in the 80–85% range before sitting for the real exam.

Use low-scoring topics to build a study list. If Finance and Closing costs you four or five points, that section's 15 items are a concrete target. Fix the known gaps before retaking the full practice exam.


Where Candidates Lose Points

Brokerage disclosure timing — The most-missed area in Listings and Agency. Candidates confuse when disclosure is required with when a relationship is established. Rule 520-1-.06 is specific; vague answers about "early in the transaction" are wrong.

Recovery Fund specifics — Questions about maximum payout amounts, claimant eligibility, and post-payment license consequences trip up candidates who studied the concept but not the numbers.

Trust account deadlines — Finance questions frequently test the one-business-day rule against plausible distractors like 24 hours or three business days. The correct statutory language is what matters, not what seems reasonable.

Community Association Management — Candidates underestimate this subtopic. The licensing requirements for community association managers are Georgia-specific and don't follow the same rules as standard brokerage activity.

Proration calculations — Closing Procedures questions may require a quick proration of taxes or rent. Candidates who haven't practiced the arithmetic lose avoidable points on straightforward math.

Misreading "client" vs. "customer" — Georgia's brokerage relationship law draws a hard line between the two. Confusing the duties owed to each is a reliable way to miss Listings and Agency questions.
